When you divorce or end a civil partnership, one of the most challenging and often misunderstood issues is how to sort out your finances. The thorny issue of money can turn an amicable separation into something far from that if professional advice is not sought at an early stage.
Financial Settlements: Our team will help you negotiate a fair financial settlement, ensuring your rights and interests are protected. We handle everything from property division to pension rights, providing clear and professional advice at every step.
Property Valuation: The value of property can be ascertained by an Estate Agent Valuation. We ensure that any outstanding mortgages and estimated costs of sale are deducted to determine the balance available for distribution.
Savings and Investments: Savings and investments are relatively easy to value by referencing statements or the most recent share prices. We help you understand your financial position clearly.
Pension Valuation: Pensions are complex, and the first step is to obtain a Cash Equivalent Transfer Value (CETV). This is a cash value placed on the pension benefits which can be transferred to an alternative scheme. However, other questions need to be asked to ascertain what the CETV represents, such as whether it is a defined benefit or a defined contribution (money purchase) scheme. An expert report from an actuary may be necessary to calculate how any pension will be apportioned as part of the financial settlement.
Debt Management: It is crucial to account for each party’s debt when calculating the overall financial position. If the debt was incurred for the benefit of the family, it is likely that both parties will be responsible for it, regardless of whether it was taken out in one name or joint names. If one party has incurred significant debt for personal benefit, such as funding of expensive hobbies, the Court may consider that person responsible for it. If one party brought significant debt to the marriage, it is more likely they will be responsible for it.
