What is a fatal accident claim?
A fatal accident claim arises when a person’s death has been caused by someone else’s negligence or wrongdoing. Under UK law, certain family members may be able to bring a claim for:
- Funeral expenses
- Financial losses, including loss of income and support which the decreased family member would have contributed to the family
- Loss of services, including childcare or household support that the deceased family member would have provided)
- The Statutory Bereavement award which is set by law and which can be applied for by certain relatives of the deceased person, depending on their circumstances.
A claim for pain, suffering and loss of amenity suffered by the deceased person between the date of the accident and the date of their death can also be pursued, along with a claim for any financial expense or time spent by others doing things that the deceased person would otherwise have done for the same period.
We can also assist with related legal processes, including providing representation at Coroner’s Inquests, to help you understand what happened and ensure your voice is heard as well as to assist with any fatal accident claim you may wish to consider once those initial proceedings have concluded
