Contaminated Land

As the demand for new housing continues to put pressure on our land, so does the pressure to develop brownfield land increase. Much remediation of land is achieved through the planning system, however, local authorities are under duties to identify contaminated land and secure the remediation. The statutory regime in the Environmental Protection Act 1990 on the allocation of liabilities is very complicated and can cause issues in the buying and selling of land.
