Director - Dispute Resolution Department
Gareth, a director in the firm's dispute resolution department, brings a wide range of experience. He specialises in securing sensible, practical and commercial resolutions to disputes involving civil and commercial contracts, shareholders, partnerships, building construction, professional negligence, and inheritance and probate. Gareth represents various types of client, including individuals and businesses, from high street firms right up to large companies.
Gareth appreciates the need to secure solutions to disputes which will enable clients to move forward without dwelling more than necessary on the past. He gives very clear advice which includes providing detailed costs estimates at the earliest stage, and he understands the importance for clients, when becoming involved in disputes, of thinking about and planning for the potential costs and timescales.
Gareth has been involved in employment cases for many years. Having worked with employer clients at a high level including Bath and Bristol Rugby Football Clubs, he continues to represent clients in cases thrown up by difficulties or disagreements between employer and employee, either during or at the end of the period of employment.
He is an accredited civil mediator and has in addition undertaken many mediations representing clients, in matters as diverse as the interpretation of insurance policies, the break-up of medical and accountancy partnerships, professional negligence, copyright relating to design of technological products for the aerospace industry, Inheritance Act disputes and challenges to wills.
He achieved national recognition in representing large numbers of claimants contesting the validity of terms in shared appreciation mortgages, and also in raising claims for compensation for environmental pollution by a major chemical company. He has also acted as a legal advisor to the Federation of Master Builders and continues to assist its members to resolve construction disputes.
Gareth brings a keen legal focus to dispute resolution, having been a lecturer at The College of Law. He has undertaken considerable advocacy at all levels of courts. If the best approach to a dispute is to be very robust and firm then he fits the bill. His mediator training, however, means that this will be a route taken only if it is to the client's benefit.
Gareth was admitted in 1986 and has been with Thring Townsend, Withy King and Bonallack and Bishop before joining Battens.
Outside Battens, Gareth is married with 2 children. He is a governor at Weymouth College. He is a qualified RFU coach and has coached Dorset and Wiltshire County Teams from U14 to U18. He currently coaches the County U15 Squad and is tasked with progressing its outstanding players to the Elite Player Development Group at the Bath Rugby Academy.
