If you know of someone who has been diagnosed with Alzheimer's and who currently pays for their care now is the time to request that the decision is reviewed.
A recent landmark decision held that Alzheimer's is a health related problem which will give hope to many families who are currently having to fund nursing home fees. The decision means that the NHS will need to pay for both the Nursing Home and associated care costs under their 'continuing care' guidelines. Costs which have already been incurred may also be claimed back retrospectively.
Prior to the case concerning Judith Roe, Alzheimer's sufferers were generally regarded as having social rather than health related needs which meant that the NHS did not provide any funding. To date over £8 million has been recovered on behalf of families who have been wrongly charged nursing home fees and no doubt since many people have yet to put in such a claim, this is likely to be only the tip of the iceberg.
