New Employment Legislation

In the fast-moving world of employment law, it is essential that employers keep up to date with the latest legislation and follow procedures to minimise the risk of heading to an Employment Tribunal.

New legislation coming in includes the Agency Workers Regulations on 1 October which requires that temporary workers are treated no less favourably than permanent employees in terms of their basic working and employment conditions. Temps are entitled to access to amenities and shared collective facilities from day one, and to information about relevant job vacancies. Those who have been on an assignment for 12 weeks or more are entitled to exactly the same rights as permanent workers – the same pay, shifts, rest breaks and annual leave. This will have a significant cost impact on all industries.

As of next year, many changes are in the pipeline for "family friendly" rights, from extending parental leave to four months, to allowing all employees to apply for flexible working. From 2015, there is also the proposal for shared maternity and paternity leave to provide for both mothers and fathers to have time off together, instead of the mother having to return to work before the father takes the remaining leave.

In dealing with any employment issues, procedures are key. If the correct procedure is followed and an employer’s decision is "reasonable" it will significantly minimise the risks of losing a case brought in an Employment Tribunal and paying large sums in compensation.

In the current economic climate, smaller businesses are at risk if they leave themselves open to claims by not following legal processes. Awards for discrimination are uncapped and can easily run into tens of thousands.
